Dr. Singh's practice focuses on client counseling, strategic portfolio management, preparation of patentability, patent validity/infringement and freedom to operate opinions, patent prosecution, and patent litigation support in the chemical, pharmaceutical and biotech fields.
Having worked for three years as a chemist in process development and up-scaling of pharmaceutical active ingredients, and nine years in the patent department of a major international generic drug company, Dr. Singh brings real world scientific and business perspective to her services. Her experience of more than five years in managing and supporting patent litigation at an international level gives her extensive knowledge of diverse patent practices not only in the United States but also throughout Europe, South Africa, Russia, CEE, and Canada. She is also well versed in the intricacies of European pharmaceutical patent related regulatory matters, in addition to the U.S. Hatch-Waxman patent and regulatory framework.
Dr Singh started her career in intellectual property at the India based generic drug company with patent searching and evaluation of active pharmaceutical ingredients and their synthetic processes for world-wide markets. She also prepared freedom to operate opinions for the chemical research department as an integral part of a team made up of in-house and external attorneys. Dr. Singh protected the company's intellectual property by identifying patenting opportunities for processes and new chemical entities, drafting and filing the patent applications, and supporting their prosecution. While based in London, England, Dr. Singh prosecuted patent applications at the EPO, drafted oppositions against competitors' patents, and oversaw patent clearances for projects. Dr. Singh also facilitated timely product launches in the region, identifying opportunities for early launches of products through patent challenges, developing grounds for patent invalidity and/or non-infringement for potential litigations, retained and instructed outside counsel for patent litigation. Dr. Singh helped the company develop the IP positions for major drug products, including atorvastatin, clarithromycin and esomeprazole. While attending law school in the evening, Dr. Singh oversaw all patent related matters for the company in Europe, Russia, CEE and South Africa, shared responsibility for Canadian and US patent matters and advised regional senior management on all strategic patent issues. She prosecuted patent application at the USPTO, assisted in FTO opinion with legal research and analysis, assisted in product selection, devised at-risk product launch strategies, coordinated multi-country patent litigation, formulated and strengthened non-infringement/invalidity arguments, reviewed pleadings, motions and briefs, participated in pre-trial preparations and attended trials, and negotiated settlements.
